The terms and conditions set forth below shall, along with the approved menu, constitute a valid and binding contract and agreement between Abode Fine Dining LLC and the customer whosename appears on the approved menu
1. Abode Fine Dining LLC (“Abode”) agrees to provide all items and services listed on approved menu. However, if Abode is unable, after its best efforts to procure required menu ingredients, Abode shall contact the client to discuss any required changes to the menu.
a. Abode agrees to arrive on the date of the event so that there is adequate time to perform the services under this Agreement. Abode shall inform client of the time it will arrive at the event.
2. Client agrees to pay Abode the total sum price agreed upon as listed on menu.
a. Client agrees to pay Abode a 33% deposit before the date of the event.
b. Client agrees to pay Abode the remainder of the total sum owed to it within 15 business days. If the total sum due is not paid in full as stated in paragraph 2.b. client agrees to pay a 5% late fee first day the balance is past due and again every 30 days until paid in full.
3. Client agrees to Abode’s late event start and end policy. An extra 5% will be added to the total sum price every 30 minutes due to a late start of the event (if the late start is not caused by Abode) or late predetermined end of service. This policy includes a 30 minute grace period for the first 30 minutes behind schedule.
4. Client agrees to Abode’s cancellation policy. Client is entitled to receive a return of deposit if client cancels with Abode within 14 days of the event date. If client fails to cancel within 14 days of the event date, Abode shall retain client’s deposit in full and client shall not be required to pay the remainder of the total sum price to Abode.
5. Should client fail to pay as required under this Agreement, client shall be responsible for all costs of collection incurred by Abode in enforcement the payment terms of this Agreement, including, but not limited to, its actual costs and attorney fees.
6. Neither Abode nor client will be liable for inadequate performance to the extent caused by a condition (for example, natural disaster, act of war or terrorism, riot, labor condition, governmental action, and Internet disturbance) that was beyond the party’s reasonable control.
7. Client agrees that if any mistake arises that prohibits Abode from providing all items and services listed in menu. Then Abode has an opportunity after being informed of the situation from client to fix the problem without any repercussions.
